Sedgwick Chudleigh partner Alex Potts has authored a white paper, What Is Mediation, and Should It Be Made Compulsory for Civil and Commercial Disputes in Bermuda? This paper reviews the mediation process in Bermuda, as well as its new presence within the family law sector and commercial and civil disputes.

Potts notes that mediation is often less costly than court proceedings and questions the role and influence the Bermuda courts have in influencing mediation as an alternative to these proceedings.

Potts poses the question “If mediation has become the ‘centerpiece’ of the family court how much longer before it becomes the ‘centerpiece’ of the commercial court as well?”
