Stephanie Sheridan Quoted in Three Law 360 Articles

San Francisco office managing partner and chair of Sedgwick’s Retail Industry Practice Group Stephanie Sheridan was quoted in three articles within two days in Law360.

Sheridan was quoted as counsel for New York & Co. Inc. in “NY & Co. Skirts Sham-Discount Suit Judge Says Lacks Detail,” published on January 4, 2017. Sheridan’s representation of the women’s work and casual clothing retailer in Rael v. New York & Co. Inc. et al resulted in stopping a proposed class action over alleged deceptive discount pricing said to trick consumers into making purchases. Sheridan said of the win, “Judge Bashant is just the latest judge to conclude that a plaintiff cannot bring a lawsuit just because she bought something that was on sale.”

In “Retail Cases To Watch In 2017,” published on January 2, legal issues that retailers will continue to face and should be watching this year were noted, such as consumers suing retailers for “phantom markdowns,” alleging that retailers are misrepresenting the regular prices of products in order to make the comparative sales prices look like better discounts than they actually are. “These [lawsuits] are a big threat to the industry,” Sheridan said. “I think this is going to be the single biggest area that will impact retailers in 2017.”

Retail Legislation and Regulation To Watch In 2017,” also published on January 2, discusses the many unknowns for retailers going into this year, including the influence of the administration of President-elect Donald Trump and new international data and privacy rules and expected revisions to deceptive pricing guidelines. In anticipation of the Federal Trade Commission’s long-overdue review of consumer pricing guidelines in 2017, Sheridan stated, “Retailers are looking for guidance because these cases have really been all over the place. If they do revisit those guides and update them, that will have major impact.”
